Acceptance of terms

By creating a FieldHarbor account or using FieldHarbor, a business agrees to these Terms of Service. If a business does not agree to these terms, it should not use FieldHarbor.

Using FieldHarbor

FieldHarbor provides software for small trade businesses to manage leads, jobs, and invoices, including sending automated text messages to customers who call a business's number and don't reach anyone. By using FieldHarbor, a business agrees to use it only for legitimate business communication with its own customers.

Prohibited use

FieldHarbor may not be used to send unsolicited marketing messages, spam, or messages to anyone who hasn't contacted the business first, and may not be used for any unlawful purpose. We may suspend or terminate an account that violates this.

Text Messaging (SMS) Program

How you opt in: FieldHarbor businesses only text people who've contacted them directly — by calling, texting, or reaching out through the business's client portal — or who are already an established customer of that business (for example, receiving an invoice or a review request after a completed job). Every message is written and sent individually by a person at the business in response to that contact or relationship. FieldHarbor does not send automated messages to people who haven't already reached out — no separate signup is required beyond contacting the business yourself.

What you'll receive: Transactional messages related to your specific inquiry or relationship with that business — for example, a reply to your call or message, a price quote, a scheduling update, or an invoice or review request after a completed job. Message frequency varies based on your interaction with the business and is not a recurring subscription. FieldHarbor does not send marketing or promotional messages.

Cost: Message and data rates may apply, depending on your mobile carrier plan.

Opt out / help: Reply STOP to any message at any time to stop receiving texts from that business. Reply HELP for assistance.

Businesses using FieldHarbor are responsible for the accuracy of the messages sent through the platform and for honoring opt-out (STOP) requests from their customers. FieldHarbor reserves the right to suspend messaging for any account found to be sending unsolicited or non-compliant messages.

Account responsibilities

A business is responsible for keeping its login credentials secure and for the accuracy of the information it enters into FieldHarbor, including customer contact details.

Intellectual property

FieldHarbor and its software remain our property. A business's own data (its leads, jobs, invoices, and customer information) remains that business's property; we don't claim ownership of it.

No warranty

FieldHarbor is provided as-is. We do our best to keep the service reliable, but don't guarantee it will be uninterrupted or error-free.

Limitation of liability

To the extent permitted by law, FieldHarbor is not liable for indirect, incidental, or consequential damages arising from use of the service. This does not limit any liability that cannot be limited under applicable law.

Termination

A business may stop using FieldHarbor at any time. We may suspend or terminate an account that violates these terms, including misuse of messaging.

Governing law

These terms are governed by the laws of the State of Maine, without regard to conflict-of-law principles.

Changes to these terms

We may update these terms as FieldHarbor changes. Continued use of FieldHarbor after an update means you accept the revised terms.
